Probationer to jail for failure to report, multiple arrests

McCOOK, Neb. — An Oberlin, Kan., woman received jail time last week in Red Willow County District Court for violating her probation sentence in a misdemeanor theft case.

The woman, 32-year-old Alicia L. Bergling, formerly of McCook, was ordered to serve 90 days in jail with credit given for one day already served during a Dec. 4, 2017, sentencing hearing. Bergling admitted to the probation violation allegations last month, which stemmed from multiple arrests beginning roughly two weeks after she received a 12 months probation sentence on Nov. 7, 2016.

According to court documents, Bergling was arrested by McCook police officers on Nov. 23, 2016, for driving under revocation and resisting arrest. She was arrested again by McCook officers on Jan. 22, 2017, for second-degree criminal trespass. A third arrest occurred in Colorado on Jan. 31, 2017, stemming from allegations of possession of a controlled substance and eluding a police officer.

According to the filed probation violations, Bergling failed to make contact with her probation officer since being placed on probation in November of 2016. The original probation sentence stemmed from her role in the theft of some $3000 in tools stolen from a rural Red Willow County shop, and subsequent attempts to sell the items online.

Bergling accepted a plea agreement in the theft case admitting guilt to a Class I misdemeanor offense for theft by receiving stolen property valued between $500 and $1500. The plea agreement reduced the charge from a Class IV felony alleging theft by receiving stolen property valued between $1500 and $5000.

Other activity in Red Willow County District Court, Dec. 4, 2017:

* A McCook man pleaded guilty to multiple charges and was subsequently scheduled for a motions hearing at 1 p.m. on Feb. 5, 2018. The man, 28-year-old Cody Maples of 1106 East A Street, is facing a Class IV felony for possession of methamphetamine; a Class 3 felony for possession of a deadly weapon by a convicted felon; a Class 3 misdemeanor for driving under suspension; an infraction for possession of drug paraphernalia; and an infraction for possession of an open alcohol container.

* A plea agreement was reached with a local sex offender reducing a Class 2A felony for violating the sex offender registration act, with a prior conviction for the same offense, down to a Class 3A felony for failing to register. The man, Robert Leo Sammon of 808 East 3rd Street, also known as Cameron Jesse Mckinley, was subsequently scheduled for sentencing at 9:45 a.m. on Feb. 5, 2018.
