Probation revoked in disturbance case

McCOOK, Neb. -- A McCook man arrested in September on a domestic assault charge which resulted in a disturbing the peace conviction and probation sentence, had his probation revoked recently and was sentenced to time served after he failed several drug tests and informed his probation officer he no longer wished to participate.

The man, 31-year-old Sean Peterson of 103 East 5th Street, was originally charged with domestic assault and child abuse following a Sept., 23, 2013, incident at 103 East 5th Street. Peterson's girlfriend reported the assault and told investigators he was armed with a shotgun and threatening to kill himself.

Peterson was subsequently arrested without incident and a .22 long rifle was confiscated but responding officers were unable to locate a shotgun.

The domestic assault charge was later amended to disturbing the peace, with Red Willow County Attorney Paul Wood indicating in court documents it was at the request of the victim, and Peterson was subsequently sentenced to 9 months probation in October 2013. Wood did not pursue the original child abuse allegation.

Court documents indicate probation violations were filed against Peterson in February 2014. The violations cited positive tests for methamphetamine and cannabis in November and December 2013, and again in January 2014, as well as Peterson informing his probation officer "he didn't wish to be on probation any longer."

Peterson denied the violations in March and subsequently failed to appear for a hearing in the case a month later.

Peterson faced sentencing on the violations on Aug. 14, 2014. Red Willow County Court Judge Anne Paine revoked his probation and sentenced him to 7 days in jail, with credit given for 7 days already served.
