Convicted felon released from probation

McCOOK, Nebraska -- A McCook man convicted of felony drug possession in 2010 and subsequently sentenced to probation, was released unsatisfactorily from his probation last week following a January conviction of shoplifting. According to court documents the offender, 23-year-old Logan J. Tschacher of 1009 W. Sixth Street, has not made any payments to Red Willow County District Court for court costs or probation fees since his 30-month probation sentence began in December 2010.

Tschacher owes District Court $1078.

Court documents detailing Tschacher's probation violations indicated the recommendation from his probation officer was that he have his probation revoked and receive a jail sentence as a result of his failure to make payments and shoplifting conviction.

Tschacher was released unsatisfactorily from his probation by Red Willow County District Court Judge David Urbom during a June 3, 2013, hearing.

Tschacher was arrested and convicted of shoplifting in January 2013 stemming from an incident involving video games at Walmart. He was fined $150 in Red Willow County Court as a result of that offense.

Tschacher's original probation sentence stemmed from a September 2010 report that he had been using meth and cocaine all day and was driving around town in possession of a large amount of drugs. He originally was charged with two Class IV Felony counts of possession of a controlled substance, a possession of marijuana infraction and a possession of drug paraphernalia infraction.

Tschacher accepted a plea agreement, offered by Red Willow County Attorney Paul Wood, that dismissed both infractions and reduced one felony possession charge to a Class I Misdemeanor charge of attempted; possession of a controlled substance. The plea agreement admitted guilt to one Class IV felony count of possession of a controlled substance as well as the misdemeanor attempted possession charge.

Tsacher was also the driver of a vehicle in 2008 that was estimated to have been traveling at 100 mph when it rolled and flipped five times in front of T.J.'s Family Fun Center bowling alley in McCook. Tschacher was treated at Community Hospital and released, alcohol was believed to be a factor at the time.
