Not guilty plea entered for 30 felonies

McCOOK, Nebraska -- A former McCook resident pleaded not guilty to 30 felony offenses earlier this month in Red Willow County District Court. The accused, 38-year-old Tim D. McMains, was subsequently scheduled for a motions hearing at 9 a.m. on Sept. 9, 2013.

McMains is charged in connection with burglaries at a total of nine local businesses and one in Bartley, as well as three churches, three non-profit organizations and six governmental offices, several of them broken into multiple times. He is also charged with stealing three vehicles and interfering with the apprehension of another man accused of burglary.

The burglaries span as far back as September 2011 and as recent as April of this year.

The charges combine for 21 Class III felony counts of burglary; five Class IV felony counts of attempting a Class III felony; three Class III felony counts of theft by unlawful taking; and one Class IV felony count of accessory to a felony.

McMains remains in custody on a $150,000 bond.

Other Aug. 5, 2013, activity in Red Willow County District Court:

* 36-year-old Gil M. Green II of Colorado Springs, Colorado, was sentenced to 30 months probation after accepting a plea agreement admitting guilt to a Class IV felony offense of possession of methamphetamine and infractions for driving with a suspended license and possession of drug paraphernalia.

During his April 21, 2013, arrest, Green was carrying a digital scale and $1200 in $20 bills, separate from the $121 he carried in his wallet. Green was originally cited with additional offenses of flight to avoid arrest, no insurance and no registration, which were not pursued by Red Willow County Attorney Paul Wood.

The arresting officer recommended the drug possession charge include intent to deliver, based on consideration of two previous drug related arrests of Green on April 6 and April 7, and that Green had in his possession methamphetamine and a digital scale during the April 21 arrest.

The April 21 incident began near the intersection of West Seventh and B Street in McCook and ended on U.S. Highway 83, across from Drive 714.

* 33-year-old Kristy Green of 915 Westridge in McCook pleaded not guilty to accessory and drug possession charges stemming from her allegedly impeding the investigation of Gil Green on May 11, 2013, while officers were attempting to execute an arrest warrant at the Indianola residence of Sheila Kay Sain.

Kristy was charged with a Class IV felony offense of possession of methamphetamine; a Class I misdemeanor offense of being an accessory to a felony; and an infraction for possession of drug paraphernalia.

She was scheduled for a motions hearing at 9 a.m. on Oct. 7, 2013.

During the original incident, Kristy was arrested for obstructing a peace officer; felony possession of a controlled substance with intent to distribute; first offense distribution of a controlled substance within 1000 feet of a school or playground; and an infraction for possession of a controlled substance.

Gil Green and Sheila Kay Sain were both arrested for felony possession of a controlled substance with intent to distribute.

* 25-year-old Holly Nation of Culbertson, Nebraska, was arraigned on charges of Class IV felony of possession of methamphetamine and an infraction for possession of marijuana.

A hearing was scheduled in the case against Nation at 11:15 a.m. on Sept. 9, 2013.

* 30-year-old Joshua R. Knappert of 916 West L Street was scheduled for a status hearing on Sept. 9, 2013, in a case against him. In June Knappert pleaded not guilty to felony possession of methamphetamine and infractions for possession of drug paraphernalia and failing to sign a turn.

* 21-year-old Steffan M. Sprinkle of 1410 W. First Street was scheduled for a hearing on Sept. 9, 2013, in the case against him. Sprinkle pleaded not guilty in February to felony distribution of marijuana.

* 55-year-old James D. Nelson of 906 East E Street denied allegations he violated his court ordered probation and a trial was subsequently scheduled for Oct. 7, 2013.

Nelson is accused of failing to report to his probation officer since January and failing to complete a mental health assessment and drug education class.

Nelson was originally sentenced to 18 months probation in April 2012 after being convicted of three misdemeanor offenses for possessing methamphetamine, marijuana and amphetamine.
