Administrative fiat oversteps the Constitution

Tyranny under the color of law is still tyranny.

November 5, 2010--the day after the election--Barack Obama acknowledged defeat of his plan to subject the citizens of the American Republic to national extortion, but declared: "Cap and Trade was just one way of skinning the cat; it was not the only way. It was a means, not an end. And I'm going to be looking for other means to address this problem."

Mr. Obama, in his dogged desire to diminish the American people, waxed rustically on the merits of "skinning cats;" but were he to shout "cry havoc and let slip the dogs of war!" our leader would truly confess his Caesar-inclined ambitions. His latest subversion of the Constitution will have no less impact on the American heartland. Excerpt page 146 from the Obama budget: "The administration continues to support greenhouse gas emissions reductions in the United States in the range of 17 percent below 2005 levels by 2020 and 83 percent by 2050." These levels were required by the same Waxman-Markey legislation that failed to pass in Congress. However, the Obama Administration found its other way of "skinning the cat"--the Environmental Protection Agency. The EPA is now poised to seize control of the economy by forcing "greenhouse gas" regulation into the 1970 Clean Air Act. This latest juggernaut of tyranny conceived by our wayward executive is designed to make our Congress and elections irrelevant. Once the EPA acquires this unrestrained unilateral authority, its regulatory machinery will methodically grind this nation's struggling economy into "green" dust. And if you think "green jobs" will save our hides, think again: most "green" industry is subsidized by the taxpayer; so we are paying government to provide us with bureaucrat-mandated jobs. Notwithstanding his rustic rhetoric, "President" Obama is proving to be a rude dictator, replete with a cabinet of empowered czars to execute his political "black ops." There may be many ways to "skin a cat"--but by his word, our fearless leader is scheming to skin Americans to the bone.

Carbon dioxide is a marginally significant component in the spectrum of substances that constitute "greenhouse" gasses. This "pollutant" is of minor impact upon the climate when compared with water vapor--which composes 98 percent of greenhouse gasses. Even if we could extract all trace of industrial CO2 from Earth's atmosphere, the reduction in global temperatures would be insignificant. Yet the damage done by EPA will be severe and lasting. Its regulatory overreach will produce no gain for local air quality, but will dramatically increase the scope and power of government. This was the intended goal of the brazen candidate who asserted his desire to "fundamentally transform America." To control every aspect of American life is the Holy Grail of the socialist. It matters little whether the desired "change" is affected by promulgating moral deprivation under color of law, or through the provocation of class envy, or by waging protracted economic warfare under the pretense of "pollution" control. The ends justify the means for those who seek "justice."

"Climate Justice" defines the EPA, as "Social Justice" defines the anti-capitalist--both are the ideology of collectivism. The equity the EPA will impose upon America is that concept of "justice" that punishes success and empowers sloth. By the canon of "climate justice," Americans cannot be allowed to continue in economic freedom. We must be compelled to voluntarily surrender our industrial liberty--and thus the need to create a crisis unique to productivity: "Man-made" climate change is the vehicle to make the socialist concept of justice a reality on the American continent. The true crisis is in the expanding sphere of spurious thought, traced by the intelligentsia responsible for converting our universities into politicized dens of pseudo science. "Man-made" climate change is a distortion of reality, allowed to affect American law and culture despite reams of evidence that discredit its claims. If this "theory" were mere erroneous science, then its advocates might be excused; but science was never their intention. Rather the game is a politicized "outcome-based science," purposed to deceive. Those invested in this game will not quit the contest; for they will not surrender that which promises to resurrect their utopian vision of "social justice" on a global scale.

Outcome-based science is the bastard child of public-private sector adultery, committed between quasi-government-corporate entities and the public-funding prostitutes who now dominate our institutions. Their legion of professional con artists pretend the practice of science, whilst with dubious digital alchemy they conjure new demons, which they quickly proclaim to be the latest threat to the planet--guaranteed to terminate all life. Thus they compel public funding for their "critical research"--and handily use the opportunity to promote their vision of "social justice." Their handiwork forms the base upon which corrupt bureaucrats construct false consensus. The spurious new creations are then refined by focus groups, politically packaged and marketed--particularly to children. Environmental crusaders, government careerists, and the malcontent sycophants of mass media each have a role to play in this Machiavellian drama. By gross distortions of reality, these actors manufacture pretense to put the precautionary principle on steroids, which then reshapes public perceptions so to change or marginalize traditional cultural behaviors. These puppet masters demand total immersion into the stagnant waters of social justice and pantheism, both of which must be prevalent for their Godless order to prevail. Reasonable dissent is ridiculed, isolated. Every facet of human existence is reproached as an "unsustainable" threat to the environment. Americans must sacrifice our liberty to "save" the planet. This mindset meshes well with social justice; because if free-market activity is presented as an attack on the planet, then by extension such actions are perceived as an attack on the global citizenry! Outcome-based science is thus used to invert and destroy the work ethic: entrepreneurial prowess and industry are portrayed as oppressive--their actions are purposed to defile the global habitat of the pantheistic collective, which must in turn be defended by the paternalistic nanny state. We must be rescued from our misplaced beliefs in God, family and individual freedom. Science will save us--particularly where the "consensus" is a pre-ordained outcome promulgated by the advocates of big government.

Man-made climate change theory has dire consequences for economic and political freedom, for the two must co-exist. However, it is difficult to get those accustomed to possessing both to surrender either--unless a convincing pretense is conjured. It must possess dire effects so overwhelming as to compel reasonable individuals to rationalize they may compromise one freedom without jeopardizing all. We were made distraught over DDT destroying the birds, a fabrication that resulted in millions of unnecessary human deaths from unchecked malaria. We were threatened by a non-existent Population Bomb, and through false guilt, many couples refused to have children--or worse, aborted them to "save the planet. " We were guaranteed to be on the cusp of a new Ice Age, which never materialized, but was soon followed by the specter of Acid Rain--a surprisingly isolated and expensive phantasm for American industry. Then came the grossly exaggerated "disaster" at Three-Mile Island, and the heavily promoted distrust of nuclear power to advance the government's war on domestic energy production. The "China Syndrome" soon faded from memory, and so Ozone depletion was hyped to re-direct our cynicism to a different American industry. Asbestos and lead paint were made our bane--and the tort-crazed trial lawyers "did not let a good crisis go to waste." Every oil spill and blowout is used to muster a "call to arms" to protect the environment and prevent development of our abundant natural resources. With each "crisis," Americans are required to tear another thread from our unique tapestry of political and economic freedoms. Minor problems are magnified and leveraged to loosen our regard for liberty, property, sovereignty-- while the anti-capitalist hypocrites reap profits from their junk science, of which man-made climate change is the epitome!

To sustain research that would otherwise lack a legitimate basis for public funding, political and corporate opportunists allied themselves with militant environmentalists to create a "global crisis"--and one based on a theory that cannot be validated through the scientific method: A premise, characterized not through objective observation and measurement, but inferred through selective data that is supportive of the desired outcome. A purposely vague hypothesis that is not demonstrated, yet assumed certain to occur in the future. The predictions are made by computer programs, which use subjective parameters to process selected data through a network of sub-routines to obtain the desired results. Near-term predictions of these models are consistently off target by orders of magnitude, yet extrapolations of the results are presented as a definitive proof of impending doom, and the justification for massive government intervention at every level. When a hypothesis fails its test, honesty requires we reject the assertion; but in the case of "man-made" climate change, the hypothesis is never rejected. Rather, its definitions are modified to include all possible outcomes: If temperatures rise, fall, or remain unchanged--global warming; Come rain, snow, or drought--global warming; Severe storms--global warming; No storms--global warming; Earthquakes? Volcanoes?--Global warming! This is not science. It is tyranny posing as science! It is a mocking pretense to legally plunder the wealth of productive nations and divest citizens of their God-given Liberty. This is the rationale Barack Obama and his EPA thugs will use to gut our hard-won freedoms ... and at that point, our little Caesar will not be "skinning" cats, but rather he will be skinning alive the American People. "Cry havoc and let slip the dogs of war!" Indeed he shall.

Our elected officials, blinded in their own imagined wisdom, refuse the sober arguments of sensible men; but rather prefer the spectacle of the incredible, peddled by the hysterical. The ugly truth is that their casual disregard for our freedoms is by way of our apathy to jealously guard them. Wake up America! You are in the crosshairs of a regulatory blitzkrieg. Do not wait until the tapestry of your freedom is reduced to a tattered remnant. Stand up and speak loudly--before the crisis merchants decide that your very existence is a threat they must terminate.

    I think there would tend to be a more acceptable or friendly attitude towards Industry demands if their track record on environmental issues was a little more encouraging. However, that is not the case.

    This same argument has been used against the EPA to allow Industry to bypass the Clean Water Act with the "Cheney Exemption", which addresses the disclosure of chemicals used in hydraulic fracking fluid.

    This same argument has been used against the EPA by Industry to avoid or slow down their toxic waste site clean-up efforts. Over 250,000 now and growing daily - ever wonder why bottled water has become so popular?

    Expensing of environmental remediation was included in the legislation passed in last years congressional session. It allowed expensing back to Dec. 31,2009 which includes the BP oil spill timeline. With over 250,000 toxic waste sites you would think there would be remediation work going on all over the country - providing the economic stimulus the expensing allowance was meant to create. Many of the companies with multiple toxic waste sites also have posted record quarterly profits in the billions of dollars. You would think with record profits and new tax allowances they would finally address their obligations to the American Public and take care of their toxic waste sites. Where are the jobs?

    The EPA did not create the toxic waste sites, Industry did.

    What does toxic waste have to do with climate change or green house gasses? Just because something is wrong or bad in one area, doesn't mean it is universally bad. I think you are going all black and white here and trying to set up a strawman argument.

    No strawman needed, just a good dose of reality. The EPA and it's often touted over - reaching has become every Industries Scapegoat when it comes to environmental accountability.

    One last comment for you to consider. Why did the Bush Administration find it necessary to edit scientific documents, sworn testimony, etc. about climate change science during his tenure? If the evidence and facts were strong enough to support his position why didn't they bring their argument forward for debate, instead of deceiving the American Public by publishing reports misrepresenting the Scientific Community?
