Jail time ordered for probation violation

McCOOK, Neb. -- A former McCook resident received jail time earlier this month in Red Willow County District Court for violating his court ordered probation. The offender, 24-year-old Clifford R. Stark of Hildreth, Nebraska, was sentenced to 120 days in county jail with credit given for 24 days already served during a Jan. 4, 2017, sentencing hearing.

Stark was accused of missing probation appointments, testing positive for marijuana and methamphetamine, failing to follow the inpatient treatment recommendations of a substance abuse evaluation and other violations. He was originally sentenced to 24 months probation in January of 2016 following a conviction on a misdemeanor offense for attempting to possess methamphetamine.

According to court documents, Stark subsequently began missing probation appointments a month after receiving the probation sentence and tested positive for marijuana and meth use in May of 2016.

Prior to the 2016 probation sentence Stark was facing multiple felonies. He was originally charged with two Class IV felony offenses alleging he was in possession of Alprazolam and Lisdexamfetamine, in addition to a third Class IV felony alleging possession of methamphetamine and an infraction alleging possession of drug paraphernalia. Red Willow County Attorney Paul Wood dismissed the Alprazolam and Lisdexamfetamine in July 0f 2015 and four months later dismissed the paraphernalia infraction and reduced the meth charge to the misdemeanor attempted possession violation Stark was ultimately convicted on.

Other activity in Red Willow County District Court, Jan. 4, 2017:

* A local sex offender was scheduled for sentencing after accepting a plea agreement admitting guilt to a misdemeanor offense for attempting to violate the sex offender registration act. The woman, 25-year-old Tai Lynn Weaver of 409 E. Third Street, was subsequently scheduled for sentencing on the Class I misdemeanor offense at 11 a.m. on March 6, 2017.

Weaver was originally facing a Class 3A felony alleging she violated the sex offender registration act by failing to update her address and contact information.

As of Friday morning the Nebraska Sex Offender Registry lists Weaver's home address as 105 Decatur in Danbury, Nebraska, with a reported date of Nov. 9, 2016.

* A status hearing was set in a criminal case against an Indiana man facing a felony methamphetamine possession charge. The man, 42-year-old Aaron K. Camara of Lafayette, Indiana, is facing a Class IV felony alleging possession of meth; a Class I misdemeanor alleging he resisted arrest; and a Class 2 misdemeanor alleging 2nd degree trespassing. Camara pleaded not guilty to the charges in December.

A status hearing was set at 10:45 a.m. on Feb. 6, 2017.

* A plea agreement was reached with a McCook man reducing a Class IV felony offense alleging he violated a protection order, while having a previous conviction for a violating a protection order, down to a Class I misdemeanor for violating a protection order. The man, 57-year-old Kirk L. Hahn of 38343 Road 714 in McCook, was subsequently scheduled for sentencing on the misdemeanor offense at 9 a.m. on Feb. 6, 2017.

Hahn was arrested in April of 2016 at Schmick's Market and cited for violating a protection order and making terroristic threats. Red Willow County Attorney Paul Wood did not purse the terroristic threats allegation.
