Plea agreement results in probation for meth charge

McCOOK, Neb. -- A McCook woman arrested on a felony drug charge in March was sentenced to probation recently in Red Willow County District Court.

The woman, 36-year-old Courtney J. Modrell of 808 E. Third Street, accepted a plea agreement in May admitting guilt to a misdemeanor offense for attempting to possess methamphetamine and dismissing an infraction alleging possession of drug paraphernalia. She was subsequently ordered to serve 24 months probation during a July 11, 2016, sentencing hearing.

Modrell was originally facing a Class IV felony offense alleging possession of methamphetamine in addition to the paraphernalia infraction.

The charges stemmed from a syringe containing methamphetamine and a cigarette pack containing crystal methamphetamine confiscated from a vehicle following a warrant stop targeting Nathan Deloach, according to court documents. Modrell and Deloach were both arrested at the time and Deloach subsequently accepted a plea agreement admitting guilt to a Class IV felony for possession of methamphetamine and similarly dismissing an infraction alleging possession of drug paraphernalia. He was sentenced in June to a combined 30 months in state prison.

Deloach was already on probation at the time of the March arrest, a sentence he received just a few weeks prior and stemming from a January arrest on felony drug and weapon charges.

Other activity in Red Willow County District Court, July 11, 2016:

* A McCook man facing a pair of Class 3 felony offenses alleging distribution of cocaine pleaded not guilty to both charges. The man, 23-year-old Edgar Rodriguez of 308 E. Third Street, was subsequently scheduled for a motions hearing at 11 a.m. on Aug. 8, 2016.

* A McCook woman pleaded not guilty to a Class IV felony offense alleging theft by receiving stolen property. The woman, 30-year-old Alicia L. Bergling of 1006 West 12th Street, was subsequently scheduled for a status hearing at 11:15 a.m. on Aug. 8, 2016.

* A 57-year-old McCook man, Kirk L. Hahn of 38343 Road 714, pleaded not guilty to a Class IV felony offense alleging he violated a protection order and had a prior protection order violation conviction. The case was subsequently scheduled for a motions hearing at 10 a.m. on Aug. 8, 2016.

* A 32-year-old McCook man, Joshua R. Lytle, pleaded not guilty to a Class IV felony offense alleging possession of methamphetamine. The case was subsequently scheduled for a motions hearing at 11:30 a.m. on Aug. 8, 2016.
