Probation violations net 280 days in jail

McCOOK, Nebraska -- A felon with a lengthy history of assault arrests who received probation last year in Red Willow County District Court after he was convicted on weapons and domestic assault charges was back in court earlier this week and sentenced to jail time on a pair of probation violations.

The offender, 38-year-old Brian D. Tynes, was ordered Wednesday to continue probation and serve 280 days in jail, with credit given for 138 days already served. His violations stem from his failure to report to his probation officer in May and absconding to California without permission, according to court documents.

Tynes was originally sentenced to 36 months probation in July of 2014 after accepting a plea agreement admitting guilt to a Class III felony offense for being a felon in possession of a knife and a pair of Class I misdemeanor offenses for domestic assault and carrying a concealed handgun. The plea agreement dismissed a Class ID felony offense for being a felon in possession of a firearm.

At the time of his 2014 arrest Tynes was carrying a loaded handgun he had reportedly stolen and was wearing a knife sheath on his hip containing a knife with a 7 inch blade. He also had a second blade in his pocket with a length just under 4 inches.

Tynes has been arrested multiple times in California for "inflicting corporal injury to a spouse or cohabitant," dating back to 1997 and as recent as 2012. Court documents indicate he was sentenced to a five year suspended prison sentence and probation as a result of a 2012 battery conviction.
