Dealing stolen gun lands man in prison

McCOOK, Nebraska -- A McCook man arrested in March for attempting to sell a rifle from the trunk of his car was sentenced to prison time earlier this month in Red Willow County District Court.

The offender, 29-year-old Kenneth D. Capps of McCook, was sentenced to 1.5 to 3 years in state prison after accepting a plea agreement in June that admitted guilt to a Class III felony offense of possession of a stolen firearm.

Capps was given credit at sentencing for 134 days already served.

Capps was originally charged with a Class ID felony offense of possession of a deadly weapon by a convicted felon. The charge stemmed from a March 2013 report of someone selling guns from the trunk of a car in the alley behind West Second Street. Capps was subsequently arrested and a camouflaged .22 250 caliber rifle with a Bushnell scope was confiscated.

Investigators later confirmed the rifle had been reported stolen in November 2012 from a rural workshop in Red Willow County.

According to court documents, Capps has a criminal history that includes previous felony convictions for fraud and dealing in stolen property.
