Motor vehicle homicide trial to be rescheduled

BEAVER CITY -- The trial of Herchel Huff, charged with killing an Arapahoe wife and mother last year, will be rescheduled.

Huff was to appear today and Wednesday in Furnas County district court in Beaver City on charges of motor vehicle homicide, driving while intoxicated (fourth offense), tampering with a witness, refusal to submit to a chemical test and no proof of insurance.

Huff, of Grant and Holbrook, is accused of killing Kasey Jo Warner, 28, as she and her daughter walked on a country road southwest of Arapahoe Oct. 3.

District Court Judge James Doyle III accepted pleas of not guilty from Huff, 34, in November.

Furnas County Attorney Tom Patterson said this morning that Judge Doyle will conduct a hearing Feb. 22 to determine progress in a Lincoln County court case in which Huff is also charged with driving while intoxicated. At that time, Doyle will set a trial date for the Furnas County charges.

Huff is a Lincoln County prisoner, and is attending an inpatient drug/alcohol treatment program in Omaha.

Its been almost a year since the accident..is Furnas county going to get with the program and do anything..or wait so long that he is able to leagally file for a mistrial because they were so slow to do anything?

myboys - i agree that the judicial system in the state of nebraska is messed up. otherwise, mr. huff wouldn't have behind the wheel that night, and instead would have already been behind bars. as for the facts, i would love to hear what you believe them to be.

mgivens- we all know that he deserves to be punished but what u guys dont know is the facts. all u know is what u read in the papers but i guess everyone will know the truth on how messed up the judical system is in this state and how many mistakes the state of nebraska has made in all of this. we cant change the past (god knows we would love to) and all i ask is that people know all the facts before they pass such harsh judgement. but u know karma is a mf!

myboys...You say that you are on the fence, and that Herchel would have never hurt anyone intentionally. I don't think he did it on purpose, but there needs to be some accountability on his part. Kasey Jo is dead because of a horrible choice that Herchel made--and as it has been said before, it wasn't the first, second, or even third time that he has been caught making that choice. (Who knows how many times he hasn't been caught?) That being said, it's too bad that Herchel's kids are also affected by his choice. But, I would argue that their loss can't compare to what Herchel took away from Kasey Jo's family and friends. She was such a special person that I named my first child after her 6 years ago. Locking him up won't bring her back, but it would keep him from hurting someone else, maybe even his own 5 children!

my thoughts and prayers go out to kaseys family but here i am caught on the fence. knowing kasey from school and herchel being my family. i can tell you he would never hurt anyone intentionally. he is just as sad and sorry that this happened then anyone else if not more. you all make comments about him being in rehab and having visitations. i bet none of you knew that he has not one not two but five children that miss him and are going through hell because he isnt here. they are what keep him going day in and day out. all we ask is please know all the facts before you pass judgement for none of you would like your dirty laundry aired everywhere. again our deepest sympathy to the family and friends she was a wonderful person and it is a terrible loss but why do more have to suffer.

It says he is in an in patient treatment program but he spent a few days with his children in North Platte a couple of weeks ago? How is that In Patient?

I think after 4 DUIs alcohol treatment may be a little late.
